Our attorneys have litigated matters involving the Clean Water Act, the Clean Air Act, CERCLA (Superfund), RCRA, the Michigan Environmental Protection Act (MEPA) and Michigan’s Natural Resources and Environmental Protection Act (NREPA). We have also represented both plaintiffs and defendants in all types of common law environmental claims (trespass, nuisance, ultra hazardous activity, etc.).
We served as co-lead counsel in the Enbridge Oil Spill Class Action Litigation, in the Federal District Court for the Western District of Michigan, arising from the largest reported oil pipeline release in Michigan’s history. That case settled, with benefits provided to thousands of local residents.
Our attorneys have been at the forefront of the development of environmental law in Michigan and were involved in leading trial and appellate cases regarding insurance coverage for environmental claims, MEPA, and landfill permitting and siting. David Fink also represented the City of Detroit and the Urban Core Mayors in lobbying for and negotiating the terms of NREPA.
